Kiaora, hereinafter referred to as "we," "us," "our," or "ourselves," owns and operates this Site, providing our clients with access to and use of specific health products and health services ("Services"). These Terms shall govern your use of all aspects of the Site, including but not limited to questionnaires, information, research, mobile applications, and any other information or services provided (collectively, the "Site"). It is important to note that Kiaora is not a medical group or doctors' organization; rather, Kiaora operates in the role of a “facilitator” by providing convenient accessibility to a team of healthcare professionals and service providers, including Doctors, Nurse Practitioners, Researchers, Pharmacists, Lab Test companies, and other affiliated specialists (collectively referred to as the "Provider(s)"), with the primary focus of promoting better health, mainly through hormone balance, hormone replacement therapy, and peptide therapy. Any terms defined herein shall have the same force and effect throughout the entirety of this Terms of Use and in all KIAORA Policies set forth and incorporated herein and/or published on the Site.
By utilizing the services of the Team of Providers, KIAORA facilitates access to telemedicine consultations and Healthcare Practitioner "visits" conducted by independent healthcare practitioners licensed in the United States. It is important to note that KIAORA does not directly provide medical treatment, medical advice, or pharmaceutical distribution, nor does it exercise ownership or control over affiliated medical practitioners. KIAORA's role is strictly that of a facilitator, offering the Site as an access point to a platform where medical professionals can independently provide their services to users. We process information provided by our clients, including lab tests and data collected through information gathering pages utilized by the Providers, to facilitate targeted health improvement solutions. As a client, you input information on the site, which Healthcare Practitioners may use to prescribe hormones, medications, and other health-improving products. These prescriptions are fulfilled by the pharmacy Provider, who is responsible for sending medications and other products to your specified address. By accepting our Terms and purchasing any prescription offered through Provider sites, you explicitly acknowledge and agree to these conditions:
- Your personal and medical information, including lab test results and responses to symptom and medical history questionnaires, will be collected by the Provider Healthcare Practitioners, Pharmacies, and other contracted Providers for the purpose of delivering the Services.
- You affirm that your responses to symptom and history questions are true, accurate, current, and comprehensive. KIAORA shall not be held liable for any loss, damage, or harm resulting from erroneous disclosures made by YOU, our client.
- You certify that you are 18 years of age or older.
- You commit to refraining from accessing the Site or using our internet platform for any unauthorized or illegal purposes.
- You possess the legal capacity to certify and agree to comply with these Terms of Use.
- You pledge to promptly update your information in your client portal via this site if any changes occur in your health status regarding the following conditions:
- Heart Attack (Myocardial Infarction) or Heart Disease
- Stroke Event
- Cancer diagnosis
- Detected liver disease
- DVT/PE, a low or high blood platelet disorder, or clotting disorder
- Graves’ Disease
- Active and Unmanaged Cardiac Arrhythmias
- Addison’s Disease
- Acute Myocarditis
- Neck or Thyroid swelling or mass
- Multiple Endocrine Neoplasia
- Gastroparesis
- Pancreatitis
- Proliferative Diabetic Retinopathy
- Renal failure requiring hemodialysis
- In the event of any aforementioned health conditions arising, you are obligated to immediately discontinue use of any medication obtained through your Providers and promptly schedule an updated telemedicine consultation with one of the Provider Practitioners. During this consultation, you must disclose all updated information or new diagnoses. You may only resume treatment if the Provider Practitioner re-approves or modifies your prescription accordingly.
- Furthermore, you agree to refrain from utilizing any non-human, automated, or hacking-associated techniques to access this site, including but not limited to scripts, bots, or other methods that extract data or compromise the site's integrity. Such actions are strictly prohibited and may result in legal consequences.
Authorization & Consent to Participate in Remote Health Services
By utilizing the Site and accessing the Services, you hereby explicitly consent to receive the Provider's services through a Remote Health evaluation (hereinafter referred to as the "evaluation"), which may also be known as a TeleHealth appointment. This agreement acknowledges your understanding and acceptance that medical consultations and services will be conducted remotely, utilizing telecommunications technology, rather than through traditional in-person visits.
- Purpose and Benefits: The primary objective and advantage of the evaluation is to facilitate more timely and accessible hormone and peptide therapies and treatments. However, it is imperative to understand that this service is not intended for emergency situations. IN THE EVENT YOU EXPERIENCE A HEALTH EMERGENCY, WHETHER RELATED OR UNRELATED TO THE SERVICES FACILITATED VIA THIS SITE, DIAL 911 AND SEEK LOCAL MEDICAL CARE. THIS SITE AND ITS ASSOCIATED SERVICES DO NOT SUBSTITUTE FOR EMERGENCY MEDICAL TREATMENT.
- Nature of Evaluation:
- A qualified health practitioner will be accessible to address any inquiries and provide assistance during the encounter, as well as to attend to any routine or emergent needs that may arise. However, it is important to note that this availability does not constitute a guarantee of immediate response or continuous monitoring.
- Non-medical technical personnel may, at their discretion, monitor the evaluation process for the purposes of addressing any potential or actual electronic transmission and/or communication issues, and to ensure quality compliance.
- Medical Information and Records: All existing laws pertaining to your access to medical information and copies of your medical records remain applicable to this evaluation. Furthermore, any dissemination of patient-identifiable images or information from this interaction to researchers or entities external to the companies providing the services is prohibited without your explicit consent, unless otherwise authorized under existing confidentiality laws. Please be advised that records and prescriptions requiring original signatures may necessitate additional processing time to accommodate secure transport from the doctor's site to the issuing pharmacy. You are hereby informed that all records and prescriptions are transmitted via secure transport or communications channels to maintain confidentiality and comply with applicable regulations.
- Modality: The evaluation shall be conducted remotely, utilizing an online questionnaire and a virtual "visit" with a licensed Healthcare Practitioner. This remote interaction may occur through either a synchronous (real-time) or asynchronous (non-real-time) TeleHealth appointment, as permitted by applicable state law. By agreeing to these terms, you acknowledge and consent to this mode of evaluation, understanding that it differs from traditional in-person medical consultations. You further affirm that you will provide accurate and complete information during the questionnaire and virtual visit to ensure the best possible care within the constraints of this remote modality.
- Confidentiality: The parties involved have implemented reasonable and appropriate measures to mitigate any confidentiality risks associated with the evaluation. You are hereby informed that all existing confidentiality protections under federal and Tennessee State laws are fully applicable to information disclosed during this evaluation. By participating in this evaluation, you acknowledge and agree that while robust safeguards are in place, no electronic transmission can be guaranteed to be 100% secure. You consent to the electronic transmission of your personal and medical information with the understanding that such transmission is protected to the fullest extent of the law.
- Fees: All applicable fees for services rendered shall be clearly disclosed to you during the online checkout process, specifically within your shopping cart. By proceeding with the transaction, you acknowledge that you have been made aware of and agree to these fees. You are advised to review the itemized costs carefully before completing your purchase.
